Doc suspected in wife's cyanide death caught in Cyprus

Law CLEVELAND, Ohio (AP) -- A fugitive doctor charged in the cyanide poisoning death of his wife has been arrested in Cyprus and will be brought back to the United States to face trial, the FBI said Monday.
Yazeed Essa, 38, of Gates Mills, east of Cleveland, Ohio, was arrested Saturday as he attempted to clear customs in Cyprus after arriving on a flight from Beirut, Lebanon, the FBI said in a news release. He will be held in Cyprus until U.S. authorities extradite him to Cleveland.

Essa was arrested on a charge of unlawful flight to avoid prosecution stemming from the aggravated murder charge filed against him in February.

Essa disappeared three weeks after his wife, Rosemarie Essa, collapsed in her car about five miles from the couple's home and died February 24, 2005.

Prosecutors have said they believe Essa, an emergency room doctor, was having an affair with a nurse and wanted to be free of his 38-year-old wife. Prosecutors characterized the killing as a "divorce substitute."

Before she collapsed and crashed into an oncoming car, Rosemarie Essa called a friend on a cell phone, gasping for air, and said her husband made her take calcium pills and she didn't feel well, prosecutors said. They say that call is their key evidence in the case.

Essa disappeared three weeks after his wife's death.

Before his arrest, authorities believed he had been in Syria, Greece and Lebanon and possibly Florida. His family owns property in the Palestinian territories, authorities said.

A brother of Rosemarie Essa, Dominic DiPuccio, filed a wrongful death lawsuit against Essa in February, asking for a jury trial to determine compensatory and punitive damages to be awarded to Rosemarie Essa's estate. DiPuccio is executor of the estate.

There was no immediate comment from Essa's lawyer, Larry Zukerman, who did not respond to a call to his office.

If convicted of aggravated murder, Essa could be sentenced to 20 years to life in prison.
