Family claims cost-cutting led to Big Dig death

Law BOSTON, Massachusetts (CNN) -- The family of a woman killed by a falling concrete ceiling panel in a Boston Big Dig tunnel said Wednesday they have filed a lawsuit alleging that the project's builders put cost savings over safety.
The husband of Milena Del Valle fought back tears while speaking to reporters through a Spanish translator on Wednesday.

"Its very hard that everything you have loved and then in one day its all gone," Angel Del Valle said. "This person killed was my wife. And that was for negligence in the job."

Wiping tears, Del Valle added, "The people that did this, they must be accountable."

Angel Del Valle was driving with his wife to Logan Airport when the multi-ton ceiling panel fell and struck their car. He was able to escape through a window, but Milena Del Valle was killed.

Del Valle and daughter Raquel Ibarra Mora filed the wrongful death lawsuit Tuesday in Suffolk Superior Court. It accuses the Massachusetts Turnpike Authority and several contractors of negligence or recklessness in installing unsafe and defective bolts, and with using defective concrete during the Big Dig project.

"What happened to Milena Del Valle should never have occurred," the Massachusetts Turnpike Authority said in a statement released Wednesday. "We are open to discussing this matter with the family and their attorneys."

"Big Dig" is the nickname for the Central Artery/Tunnel project, which reroutes the once-elevated Interstate 93 beneath the city. The project connects the Ted Williams Tunnel, a freeway to Logan Airport and a major bridge over the Charles River.

Gov. Mitt Romney's office took control of the system from the Massachusetts Turnpike Authority after the accident, pushing out the agency's director and launching an investigation that raised questions about 1,400 epoxy-held bolts that support the ceiling panels

On August 8, Massachusetts reopened an entrance to the Big Dig tunnel that was closed after Del Valle was killed. Engineers have since found problems with other ceiling supports in the roadway.

Romney has promised a "stem-to-stern review" of the $14.6 billion, 15-year project, to be conducted by independent experts unconnected to the project's main contractors. Several other portions of the roadway, which was designed to carry 250,000 vehicles a day, remain closed.
